The consolidated appeal will specifically challenge the PBGCs attempt to keep participants from appealing who have missed the 45-day appeal window. To date over 1,500 DP3 members have had their appeal deadline extended in connection with the DP3 Consolidated Appeal, but a significant number have had their extension request denied because it was not made within 45 days of the PBGCs benefit determination. We believe this determination is wrong for many reasons, not the least of which is the fact that the PBGC is extinguishing appeal rights for these individuals even before it has turned over to the participant all the information it used in making its decision. Almost a full year has gone by without the PBGC being able to produce this information, so it seems to us unreasonable to attempt to exclude individuals who have not met the PBGCs arbitrary 45-day deadline.
